The Yearly Forms for a Trust with Heirs Abroad: A Table by Country
France also charges a yearly 1.5% levy on trust assets not declared for its wealth tax.
Picture a trust set up by a couple in Canada. A trustee in another country runs it. Their three children live in Spain, Japan and Brazil. How many forms does that trust create in a year, and who files each one?
The sources point to three groups of filers. The trustee files for the trust. The person who set it up may file in the home country. Each heir files in the country where they live. The table lists what the sources name.
The forms, by filer
| Filer | Form or register | When | What the sources give for a late or missing filing |
|---|---|---|---|
| US trustee | Form 1041 and a statement to each beneficiary | April 15, extendable by 5.5 months | |

The United States, United Kingdom, France and Germany rows rest on tax office or government pages (tier A). The Canadian penalty comes from a large firm's guide (tier B) and the Australian one from a page of tier U. The Japan row is tier A, the Mexico and Brazil rows tier B, and the Spain row tier C.
Where the sources differ
France is the clear case. A 2012 article gives EUR 10,000 or 5%. An older tax office note gives EUR 20,000 or 12.5% of the trust's value, if higher. A 2026 firm page gives a fixed EUR 20,000 with an 80% surcharge on tax reassessed. Tier A and tier C sources are both in the mix. France also charges a yearly 1.5% levy on trust assets not declared for its wealth tax.
Canada has a second layer. A Canadian who contributes to a non-resident trust files form T1141. One older source (tier C, 2020) puts the penalty at CAD 2,500 a year, with CAD 500 a month for knowing failures, up to CAD 12,000.
You could
You could write each filer's name on a sheet, with the dates from the table beside it. You could ask your trustee for a yearly calendar that includes your heirs' countries.
Which of these forms has surprised your family, or might? If you have filed one, tell us how long it took. Someone with heirs in the same country may find it useful.
Figures are estimates for planning, based on public data. Date read: October 2026.
